Privacy Policy of the WEINIG App Suite pursuant to Art. 13 GDPR

1 Controller

The data controller responsible for the collection, processing and use of personal data in connection with the WEINIG App Suite (hereinafter also referred to as the "App") is

2 Data transfer to third parties

All data collected, processed and saved in the App or in centralised systems remain under the control of WEINIG VERTRIEB UND SERVICE GMBH & CO. KG. Any transfer will only take place within the WEINIG Group to handle service requests and to service providers obliged to protect data for provision of the service. The data is not transferred to any other third parties.

 

3 Installing the WEINIG App Suite

The App can be obtained via third-party operated platforms, so-called app stores (Google Play Store and Apple App Store). Downloading the App may require you to register with the respective app store beforehand and to install the app store software. The data controller according to chapter 1 has no influence on the collection, processing and use of personal data in connection with your registration and the provision of the download link in the respective app store and the app store software. The solely responsible controller in this case is the operator of the app store in question. Please contact the respective app store provider directly if you have any questions.

 

4 Description of data processing

Please find below information on which data are collected, processed and saved in connection with the App.

4.1 Registration of a user account

You can use the App without registering. Individual personalised services within the App, however, require the registration or log in with a user account in order to work.


The App requires the following data for registration/log in after installation:

• First name and surname

• E-mail address (used as unique user name)

• Company name including address

• Phone number (for queries concerning machine identification)

These data are necessary for individual services of the App to work. These include, for example, contacting customer service and displaying machine information.


The machine details are assigned to your user account by a WEINIG service employee after your registration is complete.


Registration is voluntary. It is based on a declaration of consent pursuant to Art. 6(1) point (a) of the General Data Protection Regulation. You have the right to withdraw your consent at any time by having your user account deleted. Please see hereto chapter 4.5 of this document. Withdrawing consent does not affect the lawfulness of any processing done until the consent was withdrawn.

4.2 User name and password

The combination of e-mail address and password is used for clear identification within the App.


You can change the personal password that you have chosen yourself when registering the user account under the menu item "Change password" in the App at any time.


It may be that your smartphone offers the option to use an existing fingerprint scanner or other biometric methods to log in. The App will not be given access to the data for unlocking and/or log in, but will only receive the notification whether identification based on these characteristics was successful or not.


Notice: If you share your device with other users, we recommend you do not use the fingerprint scanner or other biometric means.

4.3 Contact forms

You can use the App to contact WEINIG. The personal data collected from you for this purpose can differ depending on the type of enquiry. We will usually ask for a means to contact you (mostly phone, e-mail) as well as the specific contents of your enquiry. If you send us an image and/or video, we will collect and process these media files and, where applicable, also your location if that information is embedded in the media data. We will share and process these data within WEINIG VERTRIEB UND SERVICE GMBH & CO. KG and/or the WEINIG Group in order to process your enquiry.

Processing is based on pre-contractual measures and/or fulfilment of the contract (service contract) pursuant to Art. 6(1) point (b) of the General Data Protection Regulation.

4.4 Data processing when using the App

When you use the App, we process the following data:


• IP address

• Date and time

• Accessed function/page of the App

If you are logged into your profile when using the App, the following data are processed as well:

• E-mail and password


This processing takes place based on our justified interest to provide and secure the technical foundation for the App and for the tracking of any disruptions or attacks on the infrastructure pursuant to Art. 6(1) point (f) of the General Data Protection Regulation.

4.5 Deletion of the user account

You can withdraw your consent to data processing according to 4.1 at any time by having your user account deleted. Please send a corresponding notification to service@weinig.com to do so. If you delete your user account, you will no longer be able to use certain functions of the App.

4.6 Notification function

By installing the App Suite on your device, you can decide whether you want to receive e-mail and/or push notifications from Weinig AG (Apple). Or you will be informed that the Weinig AG offer includes e-mail and/or push notifications, which you can switch off (Android). We collect, store and use the following data to send the push notifications: A unique ID, headline and text of the notification. If the end device has an iOS operating system, this data is transmitted to Google and Apple. If the end device has an Android operating system, the data is only transmitted to Google. To differentiate between the operating systems, a parameter "os" (Android or iOS operating systems) is also used. We collect, store and use the following data to send the email notifications: The target email address, heading (subject) and text (content) of the notification. This data is transmitted to your, our and all intermediate e-mail providers.

The data is required to ensure device-specific delivery of the push notifications according to the notification configuration in the app. The legal basis for the processing of this data is your consent, Art. 6 para. 1 a) DSGVO. You can deactivate the notification function at any time by switching off the notification function in the settings of the installed Weinig App Suite.

 

5 Necessary permissions

In order to use the full functionality of the App, certain system permissions and permissions regarding personal data are required. This means that you will be asked to grant these permissions once when you first access the App or only when you first access the function in question.

Network access and network connections


A network access is necessary for registration, downloading machine data and for service enquiries and contacts, the WEINIG News and the use of the WEINIG Shop.


Camera and photo gallery


In order to take pictures or to use photos that were already taken in the App, for example for service enquiries, access to your system's camera and/or the pictures stored on your device is required. Of course, the App will only use such pictures that you have expressly added to the App.


Location data


As the location of the image is usually embedded in the picture in the form of GPS data, it may be that the App will also request the permission to access the location data. Whether pictures can be taken and used without this permission depends on the device.


Memory


In order to attach pictures or documents to service enquiries, the App requires access to saved data.

 

6 Managing access permissions and revocation

You can use the appropriate function of the operating system at any time to track which permissions you have already granted and, as the case may be, revoke these. In order for all parts of the App to function as intended, it is necessary for you to grant the personal data-related permissions that are requested.

 

7 Storage periods and erasure of the data used

The App and the servers of the data controller process the following personal data:

• First name and surname• Password• E-mail address• The name of your company including address• Phone number• IP address• Date and time• Accessed function/page of the App

• Data you have disclosed when contacting us


You can have individual personal data as well as your entire user registration erased as described chapter 4.5. However, it may then no longer be possible to use the personalised services.

Technical log data are erased after 30 days. Currently, your user account will not be routinely deleted automatically in case of inactivity.

Data you disclosed when contacting us (e.g. service enquiry) are erased or blocked after your enquiry was definitively resolved. Depending on the type of your enquiry or its processing, it may be necessary for us to retain the data for longer due to legal requirements (Art. 6(1) point (c) of the General Data Protection Regulation), for example in case of chargeable services.

 

8 Data collection for analysis purposes and error correction

The App does not use technology to track or document user interactions. Neither will crash reports or similar notifications be sent.

 

9 Changes or amendments to the privacy policy

Further development of our App or the implementation of new technologies may necessitate changes to this privacy policy. We will notify you via appropriate channels in case of changes.

 

10 Your rights

You are of course in control of any and all personal data you are making available either directly or indirectly when visiting the website or using our services. According to applicable law, we are required to provide you with information on your rights. You will incur no costs for exercising and executing these rights (you may incur charges for communication with us, such as postage). Please send an e-mail to service@weinig.com in order to exercise your rights.

10.1 Right to access

You have the right to be granted access to your personal data that we store at any time.

10.2 Right to withdrawal

You have the right to withdraw your consent regarding the collection of data at any time. This right applies with effect for the future; any data we collected until the withdrawal remain unaffected by a withdrawal.

10.3 Right to data portability

You have the right to receive your data in a common, machine-readable format, and/or to ask us to transfer your data from us to another body/data controller.

10.4 Right to rectification, erasure or restriction of processing

You have the right to have your data rectified or erased or to have processing thereof restricted.

10.5 Right to file a complaint

You have the right to file a complaint with a supervisory authority and/or responsible body if you have any reason to do so. To exercise this and all of the previously stated rights, please contact the persons listed at the end of this privacy policy.
